PawFurEver offers this website, including all information, tools, products, and services available from this site, to you conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referenced here or available by hyperlink. These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and contributors of content.

Please read these Terms carefully before accessing or using our website. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services.

3. Online store terms and eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction, including copyright laws.

You must not transmit any worms, viruses, or any code of a destructive nature. A breach or violation of any of these Terms will result in immediate termination of your Services.

4. Accuracy, completeness, and timeliness of information

We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting more accurate, complete, or timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information. You agree that it is your responsibility to monitor changes to our site.

5. Products, personalization, and product descriptions

5.1 Product availability and descriptions

Certain products may be available exclusively online through the website. These products may have limited quantities and are subject to our Refund and Return Policy.

We have made every effort to display as accurately as possible the colors, finishes, engraving, and images of our products. We cannot guarantee that your computer monitor or mobile display will show colors accurately. Slight variations in color, engraving depth, finish, hardware, and handmade or made-to-order details are normal and are not considered defects.

We reserve the right to limit the quantities of any products or services that we offer, and to discontinue any product at any time. All descriptions of products and product pricing are subject to change at any time without notice, at our sole discretion.

5.2 Personalized and made-to-order products

Most PawFurEver products are personalized and produced specifically for you after your order is placed. This is important, so please read this section carefully.

• You are solely responsible for the accuracy of all personalization details you submit, including names, phone numbers, addresses, spelling, capitalization, medical or dietary notes, dates, breed, and any other text or image you provide.
• We produce your item using the information exactly as you submit it. We do not correct spelling, grammar, capitalization, or formatting.
• Personalization is limited by the size, shape, and engraving area of each product. We may adjust font size, line breaks, or spacing so your text fits the product. We may contact you if your text cannot be reproduced legibly.
• Because personalized items cannot be restocked or resold, they are not eligible for return, exchange, or refund except where the item arrives damaged, defective, or materially different from what you ordered. Please see our Refund and Return Policy for full details.
• Once an order enters production, it generally cannot be changed or canceled. If you need to correct an order, contact us immediately at contact@pawfurever.com and we will do our best to help, but we cannot guarantee that changes are possible.

5.3 Pet safety and proper use of products

PawFurEver products are accessories and identification aids. They are not safety devices, restraint systems, medical devices, or containment systems, and they do not replace supervision, secure fencing, proper training, veterinary care, or a microchip.

You agree to use our products responsibly, including the following:

• Inspect tags, collars, leashes, hardware, split rings, and attachment points regularly for wear, corrosion, or damage, and replace them when worn.
• Choose the correct size and fit for your pet, and check fit regularly, especially for growing animals.
• Supervise your pet when wearing any collar, tag, or accessory. Collars and tags can catch on objects, crates, fencing, furniture, and other animals.
• Keep tags, split rings, hardware, packaging, and small parts away from pets and children who may chew or swallow them.
• Do not use collars, leashes, or accessories for tethering, tie-outs, restraint in a vehicle, or any purpose other than the intended use.
• Follow any care, cleaning, and use instructions provided with the product.

To the fullest extent permitted by law, PawFurEver is not liable for injury, illness, loss, escape, or death of any animal or person arising from the use, misuse, failure, wear, or removal of any product.

6. QR tags, scan pages, and pet recovery features

Some PawFurEver products include a QR code that links to a pet profile page, along with related features that may be offered through our website or mobile app.

Please understand clearly how these features work:

• A QR tag is not a GPS device. It does not track, locate, or transmit the position of your pet. It does not provide live tracking.
• These features only work if a person finds your pet, notices the tag, chooses to scan it with a compatible device, and has a working internet connection.
• Any location information associated with a scan reflects the approximate location of the scanning device at the time of the scan, if that device shares it, and not the location of your pet.
• Notifications, alerts, messages, and scan information depend on third-party systems including wireless carriers, internet providers, mobile operating systems, mapping providers, and email and messaging services. Delivery, timing, and accuracy cannot be guaranteed.
• Availability of the scan page and related features depends on the site, app, and hosting services being operational. We may perform maintenance, updates, or changes that temporarily interrupt availability.

We cannot and do not guarantee that a lost pet will be found, identified, or returned. These features are intended to improve the chances that someone who finds your pet can reach you, and they work best alongside a current microchip registration, a durable engraved tag, and other identification methods.

You are responsible for keeping your pet profile information current and accurate, including your phone number, email address, and any medical or handling notes you choose to display. We are not responsible for failed contact attempts caused by outdated, incomplete, or incorrect information.

7. Accounts, the PawFurEver app, and subscriptions

7.1 Accounts

Some features require you to create an account. You agree to provide accurate and complete information, to keep it up to date, and to keep your login credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly at contact@pawfurever.com if you believe your account has been accessed without your authorization.

We may suspend or terminate an account that violates these Terms, is used for fraudulent or abusive activity, or is inactive for an extended period.

7.2 License to use the app and digital features

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the PawFurEver app and digital features for your own personal, non-commercial use. You may not copy, modify, reverse engineer, resell, sublicense, or create derivative works from our software or content.

7.3 Subscriptions and automatic renewal

Certain features may be offered on a paid subscription basis. If you purchase a subscription, the following applies:

• Pricing, billing frequency, and included features are as presented to you at the time of purchase. Current plan details and any limits, such as the number of pet profiles included, are displayed before you complete checkout.
• Subscriptions automatically renew at the end of each billing period at the then-current rate until canceled.
• You may cancel at any time through your account settings or the app store where the subscription was purchased. Cancellation takes effect at the end of the current billing period.
• Unless required by law, subscription fees are non-refundable, and we do not provide refunds or credits for partial billing periods or unused features.
• If a subscription lapses or is canceled, paid features may become unavailable. Core product functionality that does not require a subscription will continue to work as described at the time of purchase.
• We may change subscription pricing or features with reasonable advance notice. Price changes apply to the next billing period after notice.
• Subscriptions purchased through the Apple App Store or Google Play are also governed by that platform's terms, and cancellations and refunds for those purchases are handled through that platform.

8. Orders, pricing, and payment

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, or the same billing or shipping address.

In the event we make a change to or cancel an order, we may attempt to notify you using the email address, billing address, or phone number provided at the time the order was made.

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases. You agree to promptly update your account and payment information, including email address, payment method, and expiration dates, so that we can complete your transactions and contact you as needed.

Prices are listed in U.S. dollars and do not include applicable taxes, duties, or shipping unless stated. Applicable sales tax is calculated and added at checkout where required.

Occasional errors occur in pricing, product descriptions, availability, or promotions. We reserve the right to correct any error and to cancel or refuse any order placed based on incorrect information, even after an order has been submitted, confirmed, or charged. If we cancel an order for this reason, we will issue a full refund of amounts charged.

Payments are processed by third-party payment processors. By submitting payment information, you authorize us and our processors to charge the payment method you provide for the total amount of your order, including taxes and shipping.

9. Shipping, delivery, and risk of loss

Production and shipping timelines shown on our site are estimates, not guarantees. Personalized items require production time before they ship.

Title and risk of loss for physical products pass to you upon our delivery of the items to the carrier. Delivery delays, misdelivery, and carrier handling are outside our control. Please see our Shipping Policy for details on handling delayed, lost, or damaged shipments.

You are responsible for providing a complete and accurate shipping address. We are not responsible for orders shipped to an address entered incorrectly at checkout. Any applicable customs duties, import taxes, or fees for international orders are your responsibility.

10. Returns, refunds, and exchanges

Our Refund and Return Policy governs returns, refunds, exchanges, replacements, and damaged or defective items, and is incorporated into these Terms.

If your order arrives damaged, defective, or materially different from what you ordered, contact us at contact@pawfurever.com within 14 days of delivery with your order number and clear photos so we can make it right.

11. Content you submit

When you upload a photo, submit text, leave a review, or otherwise provide content to us ("User Content"), the following applies.

You represent and warrant that:

• You own the User Content or have all necessary rights and permissions to submit it and to allow us to use it as described here.
• The User Content does not infringe any copyright, trademark, right of publicity, privacy right, or other right of any third party. This includes professional photographs, licensed characters, sports and entertainment logos, and brand marks you do not own.
• The User Content is not unlawful, defamatory, obscene, hateful, harassing, or otherwise objectionable.
• Any image of a person included in your submission has been provided with that person's consent, or the consent of their parent or guardian if they are a minor.

You grant PawFurEver a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, store, reproduce, modify, adapt, and process your User Content for the purpose of producing your order, providing customer support, and operating our services.

Separately, we will not use your pet photos or personal images in marketing, advertising, or social media without your permission, other than customer reviews and content you publicly post and tag to us, which you grant us permission to repost with attribution.

We may, but have no obligation to, screen, edit, remove, or refuse any User Content for any reason, including content we determine in our sole discretion to be unlawful, offensive, infringing, or otherwise in violation of these Terms. We may cancel and refund an order rather than produce personalization we believe to be infringing or objectionable.

You agree that your submissions will not violate any right of any third party and will not contain libelous or otherwise unlawful, abusive, or obscene material. You are solely responsible for any User Content you make and its accuracy. We take no responsibility and assume no liability for User Content posted by you or any third party.

12. Marketing communications

By providing your email address or phone number, you may receive transactional messages about your order. You may also opt in to receive marketing emails or text messages.

If you opt in to text messages, message and data rates may apply, message frequency varies, and you may opt out at any time by replying STOP. Reply HELP for help. Consent to receive marketing messages is not a condition of purchase.

13. Intellectual property

All content on this site, including text, graphics, logos, product designs, artwork, photographs, illustrations, icons, software, and the compilation of this content, is the property of Ausindus LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

The PawFurEver name, logo, and related marks are trademarks of Ausindus LLC. You may not use them without our prior written permission.

Nothing in these Terms grants you any right to reproduce, distribute, publicly display, sell, or create derivative works from our content or products, including reselling our products or reproducing our designs, without our written permission.

14. Third-party links and services

Our site and services may include links to, or integrations with, third-party websites, applications, and services that are not owned or controlled by us, including payment processors, shipping carriers, analytics providers, review platforms, mapping services, and app stores.

We are not responsible for examining or evaluating the content or accuracy of third-party materials, and we do not warrant and will not have any liability for any third-party materials, websites, products, or services. Please review the terms and privacy policies of any third party carefully before engaging in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to that third party.

15. Prohibited uses

In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content:

• for any unlawful purpose, or to solicit others to perform or participate in any unlawful acts;
• to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances;
• to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
• to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
• to submit false or misleading information;
• to upload or transmit viruses or any other type of malicious code that will or may affect the functionality or operation of the Service, of related websites, or of the internet;
• to collect or track the personal information of others;
• to spam, phish, pharm, pretext, spider, crawl, or scrape;
• for any obscene or immoral purpose; or
• to interfere with or circumvent the security features of the Service, related websites, or the internet.

We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

16. Disclaimer of warranties

We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and services delivered to you through the Service are, except as expressly stated by us, provided "as is" and "as available" for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

17. Limitation of liability

To the fullest extent permitted by law, in no case shall Ausindus LLC, PawFurEver, or our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.

This includes, without limitation, any claim arising from a pet becoming lost, injured, or not recovered, and from any failure, delay, or interruption of any QR scan page, notification, alert, or app feature.

To the fullest extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to these Terms, the Service, or any product shall not exceed the amount you paid to us for the product or service giving rise to the claim.

Because some jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions our liability shall be limited to the maximum extent permitted by law.

18. Indemnification

You agree to indemnify, defend, and hold harmless Ausindus LLC, PawFurEver, and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, your violation of any law or the rights of a third party, or any content you submit to us.

19. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

20. Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. We may deny you access to our Services or any part of them.

21. Entire agreement

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

22. Governing law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms, the Service, or any product shall be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to personal jurisdiction there.

23. Dispute resolution

Before filing any formal claim, you agree to first contact us at contact@pawfurever.com and attempt to resolve the dispute informally. We will do the same. Most concerns can be resolved quickly this way.

If the dispute is not resolved informally within 30 days, either party may pursue the claim in the courts identified in Section 22, except that either party may bring an individual claim in small claims court.

24. Force majeure

We are not liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, severe weather, fire, flood, epidemic or pandemic, labor disputes, supplier or manufacturing failures, material shortages, carrier delays, utility or internet outages, hosting or platform failures, cyberattacks, war, terrorism, or governmental action.

25. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets.
